What is a cross lease to freehold?
Cross lease developments were a popular way to put many properties on one land title to avoid the cost of subdivision. However, cross lease titles are often considered to be undesirable as the land is jointly owned by all the properties on the title. This means all owners must agree to any changes made to the land. Property owners also often share driveways and amenities, and share the costs of maintenance.
Properties on cross lease titles also tend to hold a lower value compared to freehold titles because of the restrictions noted above.
If your home has been built on a cross lease title, you have the option to convert it to a freehold title. Cross lease subdivisions were used to avoid council contributions, but this loophole has been removed and now cross lease to freehold conversions have a number of advantages and disadvantages.
Why you may need a cross lease to freehold survey.
The main disadvantage with a cross lease title is you need the consent of all title holders to make changes to the land.
A freehold title gives you sole rights to use the land, so a cross lease to freehold conversion makes that possible. Converting to a freehold title will also increase the value of your property.
